UPDATE: Charges were dismissed “without prejudice”, meaning they could re-file, yet they never did. The question is, “why”? I believe it might have had something to do with my IPRA request to the District Attorney’s office for the evidence they relied on to file the charges in the first place. Maybe this was not the reason they did not pursue the charges, I will never know. What I do know is that the house has remained vacant and falling apart since the “eviction” and arrest. A new case was filed for a quiet title action because, wouldn’t you know, the “purchaser”/”plaintiff” didn’t have clear title. I am leaving the post as-is, even though there have been updates to the situation.

One of the fiercest foreclosure fighters in New Mexico was jailed and is charged with felony crimes for protecting her lawfully owned home and needs your help! First they experienced a home invasion, then, when they reclaimed what they were forced to abandon, they were arrested (without a warrant) based on lies. The shell game created by the Wall Street mortgage and house theft industry now allows the theft of property, with the help of police officers, through false claims made by real estate agency office staff, a convicted felon who is profiting from the sale of the property, and another convicted felon, who helps break and enter as a “locksmith”. Falsely labeled as “tenants”, these property owners who claim rights to the original land patent via a properly recorded chain of title superior to the “title” naming a non-existent legal entity, which is named as holder of an inferior, equitable “special  master’s deed” that is currently being challenged. 

A party in the shadows that is operating without any authority given that its limited power of attorney is invalidated, falsely calling itself a “servicer”, has purportedly enlisted Santa Fe Realty Unlimited to apparently steal homes for its own benefit. Or who’s benefit? We are still unraveling this part of the scheme. What we know for sure is that the party claiming rights to possession has never had its interest litigated or adjudicated. The entity named on the “deed” is NON-EXISTENT. The people given possession are real estate employees and agents, not acting under any agency relationship between the NON-EXISTENT “owner” of the “special master’s deed” but likely under some blanket contract with a non-servicing “servicer”. The special master’s deed is acknowledged by an individual who claims to have “sold the property” based on a Judgment when in actuality all this individual does, is read a document on the footsteps of the courthouse and then signs documents drafted by foreclosure mill law firms who refuse to prove their own agency relationship with the so-called NON-EXISTENT “plaintiff”. Statutes and court rules are being used and abused and biased judges are going along with the scheme without even reading the pleadings of the homeowner victims.

YOU ARE A TENANT, plain and simple. That’s what they want you to believe. All of your hard-earned money you think is going toward paying off your home so you own it “free and clear” is reduced to mere rent. In fact, you funded the entire scheme but nobody told you that.

Follow this closely and stay tuned! Innocent until proven guilty, and proof beyond a reasonable doubt is required. What will our legal system do? We sure hope some of these concepts are still available because in our experience, the court system is bent on handing properties over to non-existent fictional entities that have absolutely no right to the property and have profited greatly from our ignorance.
